Uniform Code of Military Justice
Article 90. Nonjudicial Punishment.
(a) A commanding officer may impose nonjudicial punishment for minor disciplinary misconduct when disposition by court-martial is unnecessary to maintain good order and discipline.
(b) Nonjudicial punishment does not constitute a criminal conviction.
(c) Nonjudicial punishment may include—
(i) reprimand;
(ii) additional duties;
(iii) restriction;
(iv) limited forfeiture of pay; and
(v) limited reduction in grade.
(d) Nonjudicial punishment shall not include—
(i) confinement;
(ii) decommissioning;
(iii) punitive discharge;
(iv) blacklisting; or
(v) ranklock.
(e) Before punishment is imposed, the member shall be informed of—
(i) the alleged misconduct;
(ii) the material evidence relied upon;
(iii) the proposed disposition; and
(iv) the opportunity to respond.
