Uniform Code of Military Justice
Article 43. Referral.
(a) A charge may be referred for trial when—
(i) jurisdiction exists over the accused;
(ii) jurisdiction exists over the alleged offense;
(iii) the specification states an offense under this Code; and
(iv) sufficient legal grounds exist to proceed.
(b) Referral shall identify—
(i) the charges and specifications referred; and
(ii) the class of court-martial.
(c) Referral does not authorize interference with the subsequent judicial determination of the case.
